Terms and Conditions

These Terms and Conditions govern access to and use of Designer Outlet, including the purchase, advertisement and sale of pre-loved designer goods through our website.

Designer Outlet is operated by RMD Designer Room Ltd, trading as Designer Outlet (“Designer Outlet”, “we”, “us” or “our”).

By accessing our website, submitting an item for sale, purchasing a selling service, contacting a seller or purchasing an item, you agree to these Terms and Conditions.

1. Definitions

In these Terms:

  • Buyer means a person purchasing or proposing to purchase an item advertised on Designer Outlet.
  • Seller means the owner of an item advertised for sale.
  • Private Seller means an individual selling an item for purposes outside their trade, business or profession.
  • Trader Seller means a person or business selling items as part of their trade, business or profession.
  • Item or Goods means clothing, footwear, handbags, jewellery, accessories or other goods advertised on Designer Outlet.
  • Self-Service means the service through which a seller pays a listing fee and manages buyer enquiries, payment and delivery directly.
  • Concierge Service means our managed selling service, under which we prepare listings and manage buyer communications, negotiations, payment and delivery arrangements on behalf of the seller.
  • Listing means an item advertisement published on Designer Outlet.
  • Platform means the Designer Outlet website and the services provided through it.
  • User means any visitor, buyer or seller using the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Designer Outlet as a buyer or seller.

By using the Platform, you confirm that the information you provide is truthful, accurate and complete.

We may refuse, suspend or terminate access to our services where we reasonably believe that a user has breached these Terms, provided false information, acted fraudulently or used the Platform unlawfully.

3. Our Role

Designer Outlet is an online marketplace for the advertisement and sale of pre-loved designer goods.

Unless a listing clearly states otherwise, the item is owned and sold by the seller identified in the listing. Designer Outlet does not purchase the seller’s item or become its legal owner.

Designer Outlet offers two selling options:

  1. Sell It Yourself — Self-Service
  2. Concierge Service

Our level of involvement depends on the service selected.

With Self-Service, we provide an advertising and enquiry platform. The buyer and seller manage the transaction directly.

With Concierge, we act on behalf of the seller in preparing the listing, communicating with buyers, managing offers and coordinating the transaction.

Designer Outlet may hold an item, communicate with buyers, collect or facilitate payment and arrange delivery without becoming the legal owner or seller of the item.

Each listing should indicate whether the seller is a Private Seller or a Trader Seller. Consumer rights may differ depending on the seller’s legal status.

4. Self-Service — Sell It Yourself

Self-Service is an advertising service for sellers who wish to advertise an item and manage the entire sale themselves.

The current Self-Service listing fees are:

  • One item: €25
  • Two items: €40
  • Three items: €55

These are once-off advertising fees. Designer Outlet takes zero commission from a successful Self-Service sale.

After purchasing the appropriate package, the seller must provide the item information and photographs requested by Designer Outlet.

Designer Outlet will prepare or publish the advertisement using the information supplied by the seller. We may make reasonable formatting, spelling or presentation changes without altering the essential information provided.

Designer Outlet Is an Advertising Platform Only

For Self-Service listings, Designer Outlet’s role is strictly limited to:

  • advertising the item on our website;
  • providing a way for an interested buyer to submit an enquiry; and
  • forwarding that enquiry to the seller.

Designer Outlet does not own, possess, inspect, authenticate or sell Self-Service items.

Designer Outlet is not the buyer, seller, agent, broker or representative of either party and is not a party to any agreement or transaction between a Self-Service buyer and seller.

Interested buyers submit their enquiries through Designer Outlet. The seller’s name, email address, telephone number and other personal contact information are not publicly displayed or automatically given to a potential buyer.

The enquiry will be forwarded to the seller using the contact information supplied by the seller. From that point, the buyer and seller communicate and deal directly with one another.

The buyer and seller are solely responsible for:

  • communicating with each other;
  • asking and answering questions;
  • verifying the item and information supplied;
  • satisfying themselves about authenticity, ownership and condition;
  • negotiating and agreeing the price;
  • deciding whether to proceed with the transaction;
  • arranging and verifying payment;
  • arranging collection, postage, insurance or delivery;
  • agreeing any return terms that may apply; and
  • resolving complaints, refunds, chargebacks, non-delivery claims or other disputes.

Designer Outlet does not negotiate, collect or hold payment, arrange delivery, inspect the item, guarantee authenticity or manage a Self-Service transaction.

The seller keeps 100% of the agreed selling price.

To the maximum extent permitted by law, Designer Outlet accepts no responsibility or liability for:

  • the accuracy of information supplied by a Self-Service seller;
  • the existence, ownership, legality, authenticity, quality, safety, condition, size or suitability of an item;
  • the ability or intention of a buyer to pay;
  • the ability or intention of a seller to supply the item;
  • payments made directly between buyers and sellers;
  • fraud, scams, chargebacks or payment reversals;
  • collection or delivery arrangements;
  • items delayed, damaged, lost or stolen in transit;
  • a buyer or seller withdrawing from or failing to complete a transaction; or
  • any disagreement, loss or dispute arising between the buyer and seller.

All Self-Service transactions are entered into at the buyer’s and seller’s own risk.

Any legal claim arising from a Self-Service item or transaction must be pursued against the relevant buyer or seller, rather than Designer Outlet, except where the loss was directly caused by Designer Outlet’s own breach of law, fraud or negligence and that liability cannot legally be excluded.

5. Concierge Service

The Concierge Service is a managed selling service for sellers who want assistance advertising and selling their designer items.

The Concierge Service costs:

  • A once-off €50 sign-up fee
  • 30% commission on the final selling price of each item sold

The €50 sign-up fee allows a seller to submit multiple items for consideration. Payment of the fee does not guarantee that every item submitted will be accepted or listed.

All items are subject to approval based on factors including brand, condition, authenticity, quality, likely selling price and suitability for Designer Outlet.

How Concierge Works

The seller must purchase the Concierge Service and pay the €50 fee through our website.

Once we receive the order, a dedicated concierge will contact the seller by telephone.

The seller may then send photographs, descriptions and other item information to us by WhatsApp or email.

Where appropriate, we may offer or arrange an in-person wardrobe consultation. The availability and location of consultations are at our discretion and will be agreed in advance.

Our concierge may:

  • review the seller’s items;
  • advise on suitable selling prices;
  • select items for listing;
  • prepare item descriptions;
  • select and edit photographs;
  • publish and promote listings;
  • respond to interested buyers;
  • answer buyer questions;
  • communicate offers to the seller;
  • negotiate on the seller’s behalf;
  • coordinate payment; and
  • arrange delivery or collection following a successful sale.

The Seller Keeps the Items Until Sold

The seller will retain possession of all Concierge items while they are being advertised.

Designer Outlet does not normally store, hold or take custody of Concierge items before a sale has been agreed.

While an item is listed, the seller is responsible for:

  • keeping it safe and secure;
  • maintaining it in the condition shown and described in the listing;
  • not wearing, using, altering, damaging or lending it in a way that changes its condition;
  • informing Designer Outlet immediately of any damage or change in condition;
  • informing Designer Outlet immediately if it is sold or reserved elsewhere; and
  • keeping the item readily available once a buyer is found.

The seller continues to own the item until it is sold to the buyer.

When an interested buyer makes an offer, our concierge will contact the seller. We may negotiate on the seller’s behalf, but we will not accept an offer below the agreed asking price without the seller’s approval unless the seller has given prior authority to negotiate within an agreed price range.

Once the item is sold and the buyer’s payment has been received or confirmed, Designer Outlet will contact the seller and arrange to receive or collect the item.

The seller must provide the sold item promptly and in the same condition in which it was advertised.

Designer Outlet will then prepare or arrange the item for tracked delivery or collection by the buyer.

When an item sells, Designer Outlet deducts its 30% commission from the final selling price. The remaining 70% is payable to the seller once the buyer’s payment has cleared and any necessary transaction checks have been completed.

Any separately agreed charges, refunds or other amounts owed by the seller may also be deducted where legally permitted and agreed.

6. Cancellation of Selling Services

Self-Service listing fees and the Concierge sign-up fee cover services that may begin shortly after an order is received.

If a seller asks us to begin providing the service during a statutory cancellation period, the seller expressly requests that performance begin immediately.

Where a legal cancellation right applies and the seller cancels before the service has been fully performed, we may deduct a reasonable and proportionate amount for work already completed.

Once a listing has been prepared or published, a change-of-mind refund of the relevant listing fee will not normally be available, subject always to any statutory rights that cannot legally be excluded.

The Concierge sign-up fee is separate from the 30% sales commission. The commission is payable only when an item sells.

 

7. Seller Responsibilities

Every seller confirms and guarantees that:

  • they are at least 18 years old;
  • they legally own the item or have the owner’s express authority to sell it;
  • they have the unrestricted right to transfer ownership to the buyer;
  • the item is authentic and genuine;
  • the item is not counterfeit, fake, copied, replicated or an unauthorised imitation;
  • the item is not stolen, unlawfully obtained or subject to finance, security or another person’s claim;
  • all information supplied about the item is complete, honest and accurate;
  • the photographs show the actual item being sold;
  • the stated brand, model, size, condition, materials and provenance are accurate to the best of their knowledge;
  • all known damage, alterations, repairs, wear, flaws and defects have been disclosed;
  • any receipt, authenticity card, serial number, certificate, packaging or proof of purchase supplied is genuine and relates to the item being sold;
  • the item may legally be advertised and sold; and
  • the sale does not infringe another person’s intellectual-property or trademark rights.

Sellers must disclose whether they are acting as a Private Seller or Trader Seller.

The seller remains fully responsible for the authenticity, ownership, description and condition of the item, whether it is sold through Self-Service or Concierge.

The seller must inform Designer Outlet immediately if:

  • the item is sold, promised or reserved elsewhere;
  • the item is no longer available;
  • the condition of the item changes;
  • any information in the listing becomes inaccurate;
  • the item is lost, damaged or altered;
  • the seller becomes aware of any concern regarding its authenticity or ownership; or
  • the seller believes an enquiry or transaction may be fraudulent.

A Concierge seller must keep the item safely in their possession and in the advertised condition until Designer Outlet requests it following a sale.

A seller must not continue to advertise or sell an item elsewhere after confirming that a Designer Outlet sale has been accepted.

The seller is responsible for losses, refunds, claims and reasonable costs arising from materially false or misleading information supplied by them, particularly where an item is found to be counterfeit, stolen, unlawfully owned or materially different from its listing.

8. Listings and Item Approval

Designer Outlet may accept or reject any item submitted for listing.

We may request further photographs, proof of purchase, authenticity documentation, measurements or other information before accepting an item.

We may edit a listing for clarity, consistency, presentation or search optimisation. We will not knowingly change material information about an item.

We may refuse, suspend or remove a listing where:

  • the item is unsuitable for the Platform;
  • its authenticity is uncertain;
  • its condition has been inaccurately described;
  • the seller has not responded to enquiries;
  • the item is no longer available;
  • the listing breaches these Terms;
  • we reasonably suspect fraud or unlawful activity; or
  • removal is necessary to protect Designer Outlet or its users.

Payment of a Self-Service listing fee or Concierge fee does not require Designer Outlet to accept an unsuitable, prohibited or potentially counterfeit item.

The payment of a Concierge fee allows a seller to submit multiple items for consideration. It does not guarantee that every item—or any minimum number of items—will be accepted or listed.

Designer Outlet may assess suitability based on factors including the brand, style, age, condition, authenticity, quality, expected resale value, buyer demand and suitability for the Designer Outlet customer.

Rejection of an item does not automatically entitle the seller to a refund of the relevant fee, subject to any statutory rights that cannot legally be excluded.

 

9. Authenticity and Counterfeit Goods

Designer Outlet has a strict policy against counterfeit goods.

Only genuine and lawfully owned designer items may be advertised or sold on Designer Outlet.

Counterfeit, fake, replica, copied, imitation or otherwise unauthorised goods are prohibited, even if the seller openly describes the item as a replica or copy.

By submitting an item, the seller guarantees that it is authentic and agrees to provide evidence of authenticity when requested.

Designer Outlet may request:

  • an original receipt or proof of purchase;
  • an authenticity card or certificate;
  • serial numbers, date codes or product codes;
  • photographs of labels, stitching, hardware, packaging or identifying features;
  • details of where and when the item was purchased;
  • identification from the seller; or
  • an independent professional authentication report.

Designer Outlet may reject, suspend or remove an item where:

  • adequate authenticity information has not been provided;
  • the item fails an authentication assessment;
  • the information supplied is inconsistent;
  • there are reasonable concerns regarding its origin or ownership; or
  • we consider that listing the item may create a risk for Designer Outlet or its users.

Designer Outlet’s review of photographs, receipts or other information does not amount to a guarantee or professional authentication unless a specific written authentication guarantee is expressly provided for that item.

The seller remains responsible for authenticity even where Designer Outlet has reviewed, approved, photographed, advertised or sold the item through Concierge.

If an item is reasonably believed or confirmed to be counterfeit, stolen or unlawfully sold:

  • the listing or transaction may be cancelled immediately;
  • the seller may be required to refund all money received;
  • Designer Outlet may refund the buyer where appropriate;
  • the seller may be responsible for payment-processing fees, delivery charges, authentication costs and other reasonable losses arising from the transaction;
  • the seller’s access to Designer Outlet may be suspended or permanently terminated; and
  • the item and relevant seller information may be reported or provided to a brand owner, payment provider, authentication provider or appropriate authority where legally required or permitted.

Designer Outlet will not knowingly return an item where doing so would be unlawful or contrary to instructions from an appropriate authority.

Nothing in this section limits any legal rights available to the buyer.

10. Item Condition and Descriptions

Pre-loved items may show signs of previous wear.

The condition of each item should be described as accurately as reasonably possible. Sellers must disclose known stains, pulls, tears, scratches, missing parts, repairs, alterations, odours, discolouration or other material defects.

Colours can appear differently depending on lighting, photography and screen settings. Measurements are approximate unless expressly stated otherwise.

Buyers are responsible for reviewing the photographs, description, measurements, sizing and condition information before committing to purchase.

Buyers should submit any important questions before purchasing.

11. Buyer Enquiries and Privacy

Buyer enquiries may be submitted through Designer Outlet.

For Self-Service listings, the enquiry will be sent to the seller. A seller’s personal information will not be displayed publicly or automatically provided to a buyer making an initial enquiry.

The seller may choose to share contact or delivery information where necessary to complete a transaction.

For Concierge listings, our concierge manages communication with the buyer and seller.

Users must not misuse another person’s contact information or use information obtained through Designer Outlet for unsolicited marketing, harassment, fraud or any unrelated purpose.

Personal information will be handled in accordance with our Privacy Policy and applicable data-protection law.

12. Prices, Offers and Sales

All prices are displayed in euro unless otherwise stated.

An advertised price may be open to negotiation, but a seller is not required to accept an offer.

Submitting an enquiry or making an offer does not guarantee that an item will be reserved or sold.

A binding sale arises when the buyer’s offer or order has been accepted and the agreed payment has been completed, subject to any applicable legal rights.

Designer Outlet may refuse or cancel a transaction where we reasonably suspect fraud, an obvious pricing error, illegality, misrepresentation or a serious breach of these Terms.

13. Payments

Self-Service Payments

For Self-Service sales, the buyer and seller agree and manage payment directly.

Payment may be arranged through methods such as bank transfer, Revolut, cash on collection or another mutually agreed method.

Designer Outlet does not hold or guarantee payments made directly between a Self-Service buyer and seller.

Buyers and sellers are responsible for taking appropriate precautions and checking that funds have fully cleared before an item is released.

Concierge Payments

For Concierge sales, payment is managed or facilitated by Designer Outlet in accordance with the instructions provided during the transaction.

Designer Outlet will deduct the agreed 30% commission before paying the seller their balance.

The seller’s payment will be made using an agreed payment method after the buyer’s funds have cleared and any necessary checks have been completed.

We may delay payment where there is a reasonable concern about fraud, ownership, authenticity, payment reversal, illegality or a material dispute.

14. Delivery and Collection

Unless otherwise stated, the buyer is responsible for delivery charges.

A €12 tracked express delivery charge may apply to purchases where delivery is arranged through Designer Outlet. Any different or additional delivery charge will be displayed or agreed before payment.

For Self-Service transactions, the buyer and seller arrange delivery or collection directly.

For Concierge transactions, Designer Outlet may coordinate tracked delivery or collection.

Items should not be dispatched until payment has cleared.

The sender must package the item appropriately and use the agreed delivery method.

Designer Outlet is not responsible for delays caused by postal or courier services outside our reasonable control.

Any claim concerning an item lost or damaged in transit will be handled according to the delivery arrangement, the courier’s terms and applicable law.

Buyers should inspect the package promptly after delivery and report any material issue without unreasonable delay.

15. Returns and Change of Mind

Designer Outlet primarily facilitates the sale of pre-loved goods owned by individual sellers.

The buyer’s return rights depend on whether the legal seller is a Private Seller or a Trader Seller.

Purchases from Private Sellers

The statutory 14-day cooling-off period that normally applies to online purchases from a business does not generally apply when goods are purchased from a Private Seller.

Unless otherwise agreed, change-of-mind returns are not accepted for purchases from Private Sellers. This includes where:

  • the item does not fit;
  • the buyer changes their mind;
  • the colour is not suitable;
  • the buyer no longer needs the item; or
  • the item is simply not to the buyer’s personal taste.

Buyers should therefore review all photographs, descriptions, sizing, measurements and condition details carefully and ask questions before purchasing.

This policy does not remove any rights or remedies that may apply where an item has been materially misrepresented or where rights cannot legally be excluded.

Purchases from Trader Sellers

Where the seller is acting as a Trader Seller, the buyer may have statutory consumer rights, including cancellation or return rights for an online purchase.

Nothing in these Terms limits any consumer right that cannot lawfully be excluded.

Free Relisting

Where a buyer decides that a correctly described item purchased from a Private Seller is unsuitable, Designer Outlet may allow the buyer to relist that same item on Designer Outlet without paying a new listing fee.

Free relisting is:

  • available for the same item only;
  • subject to the item remaining in substantially the same condition;
  • subject to Designer Outlet’s approval; and
  • a relisting service rather than a refund or return.

The new owner becomes responsible for the accuracy of the new listing and for disclosing any change in the item’s condition.

16. Materially Incorrect or Misrepresented Items

A buyer who believes that an item is materially different from its listing should contact the seller and info@designeroutlet.ie promptly, providing photographs and an explanation of the issue.

Normal signs of wear already disclosed in the listing, minor colour differences caused by screens or lighting, and sizing or fit issues do not by themselves mean that an item was misrepresented.

For a Self-Service transaction, the buyer and seller are primarily responsible for resolving the matter directly.

For a Concierge transaction, Designer Outlet may assist with communication and review the information supplied by both parties.

Nothing in this section limits any legal rights that apply to the transaction.

17. No Guarantee of Sale

Designer Outlet does not guarantee that an item will sell, that it will sell within a particular period or that it will achieve a particular price.

Any pricing or sales guidance given by Designer Outlet is an opinion based on available information and does not constitute a valuation or guarantee.

We do not guarantee that every buyer or seller will complete a proposed transaction.

18. Fraud and Safe Trading

Users must remain alert to scams and fraudulent communications.

Designer Outlet will never ask a user to disclose their online banking password, complete card security details, account password or other confidential security credentials by email, text message or social media.

Users should not release an item until the agreed payment has fully cleared.

Suspicious communications should be reported to info@designeroutlet.ie.

We may suspend listings, withhold a transaction or contact relevant payment providers or authorities where we reasonably suspect fraud or unlawful activity.

19. Prohibited Conduct

Users must not:

  • provide false or misleading information;
  • advertise counterfeit, stolen or prohibited goods;
  • impersonate another person;
  • misuse another user’s personal information;
  • interfere with the operation or security of the website;
  • introduce malware or harmful code;
  • use the Platform for unlawful purposes;
  • infringe intellectual-property rights;
  • harass or threaten another user;
  • attempt to manipulate prices or transactions;
  • use stolen or unauthorised payment information; or
  • act in a way that may damage Designer Outlet or its users.

20. Intellectual Property

The Designer Outlet name, branding, website design, written content, graphics and other materials owned or licensed by RMD Designer Room Ltd are protected by intellectual-property law.

Users may not reproduce, distribute, modify or commercially exploit our materials without prior written permission.

By submitting photographs and listing information, a seller grants Designer Outlet a non-exclusive, royalty-free licence to use, edit, reproduce and publish those materials for the purpose of listing, advertising and promoting the item and the Designer Outlet service.

The seller confirms that they own the submitted content or have permission to use it.

21. Privacy and Communications

We process personal information in accordance with our Privacy Policy and applicable data-protection law.

By purchasing a service or submitting an enquiry, users agree that we may contact them where reasonably necessary to provide the requested service, manage a listing or transaction, address a dispute or administer their account.

Marketing communications will be sent only where permitted. Users may unsubscribe from marketing without affecting essential service communications.

22. Availability of the Platform

We aim to keep the Platform available but do not guarantee uninterrupted or error-free access.

We may change, suspend or withdraw part of the Platform for maintenance, security, legal or operational reasons.

Listings may temporarily be unavailable because of technical issues, updates or circumstances outside our reasonable control.

23. Disclaimers and Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the maximum extent permitted by law, Designer Outlet is not responsible for:

  • indirect or consequential losses;
  • loss of profit or opportunity;
  • inaccurate information supplied by a seller;
  • a buyer or seller failing to complete a transaction;
  • loss caused by payments arranged directly between users;
  • delays, loss or damage caused by an independent courier;
  • undisclosed defects that Designer Outlet could not reasonably have known about;
  • misuse of the Platform by another user; or
  • events outside our reasonable control.

Designer Outlet does not manufacture the items advertised and does not provide a general warranty regarding their durability, suitability or performance.

Nothing in these Terms affects a user’s statutory rights or excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot legally be excluded.

24. Indemnity

To the extent permitted by law, a user will be responsible for reasonably foreseeable losses, claims or costs incurred by Designer Outlet as a direct result of that user:

  • breaching these Terms;
  • providing materially false information;
  • infringing another person’s rights;
  • selling counterfeit, stolen or unlawful goods; or
  • using the Platform unlawfully.

This section does not apply where the loss was caused by Designer Outlet’s own breach, negligence or unlawful conduct.

25. Complaints and Disputes

If you have a complaint about a service provided by Designer Outlet, please contact:

Please include your name, order or listing details and a clear explanation of the issue.

We will aim to review complaints fairly and respond within a reasonable period.

Disputes between a Self-Service buyer and seller should initially be addressed directly between those parties.

Designer Outlet may assist with communication but is not required to decide a private dispute or provide compensation on behalf of another user.

Where payment was made through a third-party payment provider, separate buyer or seller protection rules may apply under that provider’s terms.

Nothing in this section prevents a user from exercising any legal right or remedy available to them.

26. Suspension and Termination

Designer Outlet may suspend, refuse or terminate a user’s access to the Platform or remove a listing where reasonably necessary because of:

  • a breach of these Terms;
  • suspected fraud;
  • unlawful activity;
  • counterfeit or stolen goods;
  • abusive conduct;
  • non-payment of fees;
  • a risk to another user; or
  • a legal or regulatory requirement.

Termination does not affect rights, fees or obligations that arose before termination.

27. Changes to These Terms

We may update these Terms to reflect changes to our services, fees, legal obligations or business operations.

The latest version will be published on this page with an updated date.

Material changes that affect an existing paid service will be communicated where reasonably required.

The Terms in effect when a transaction or service was agreed will normally apply to that transaction or service, unless a legal change requires otherwise.

28. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

29. No Waiver

If Designer Outlet does not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

30. Entire Agreement

These Terms, together with our Privacy Policy and any specific written terms displayed or agreed for a service or transaction, form the agreement between the user and Designer Outlet.

If there is a conflict, any specific written terms agreed for a particular service or transaction will apply to that service or transaction, subject to applicable law.

31. Governing Law

These Terms are governed by the laws of Ireland.

The courts of Ireland will have jurisdiction, subject to any mandatory rights a consumer may have to bring proceedings elsewhere.
